The unpair/reset (press casebutton 10 sec with case opened) doesn’t resolve it for me.
I’ll follow up when I hear from FP Support.

Damn… I’m on the market for new earbuds because my hateful JBL Tune 230NC have the same exact problem and they’re driving me insane, and I kind of liked the fact that the Fairphone Earbuds have volume control - which the JBLs lack.
But… If they have the same problem, I think I’ll give them a hard pass.
I have this same issue on my FP4.
I opened a support case. They asked me to send my earbuds to a repairing facility where they where checked. I then received a new pair and had no problems since then (Spring/Summer 2023)
